Terms of Use

The Terms of Use detailed below have been put in place in order to ensure a safe and enjoyable stay for staying guests. Please take the time read the Terms of Use. Furthermore, we ask for you cooperation in following the instructions of the hotel staff that are made based on these Terms of Use.
If a guest does not follow these Terms of Use, then please understand that we may not allow such guest to use the facilities or stay at the hotel. This hotel will not bear any responsibility for damages occurring to guests due them not having these followed these Terms of Use. Furthermore, the hotel shall receive compensation in cases where the hotel has incurred damages.

Use of the Hotel

  • Without the permission of the hotel, the following shall be prohibited within the hotel’s grounds: the display and distribution of promotional materials, the sale of goods, distributing of flyers, collecting signatures and other promotional activities.
  • Please refrain from ordering or bringing food and drinks from outside the hotel into the hotel without the permission of the hotel.
  • We may refuse minors on their own from staying overnight if they do not have the permission from their parents.
  • Gratuities for staff are not accepted.
  • When using the lounge or other shared areas at times when these are busy, we may ask you to limit the time you use these spaces
  • This is a no-smoking hotel, including in guest rooms. Please refrain from smoking in the hotel grounds.
  • If the hotel or other guests suffers damage due a guest’s deliberate or negligent act, compensation will be paid by the guest who committed the act.
  • Any person for whom any of the following is applicable may not be allowed to use the facilities or stay overnight, in such a case , their entry and exit to and from the hotel and their movement around may be limited
    • In cases where it is suspected that the person has contracted food poising such as the Norovirus.
    • For the purpose of protecting against infectious disease, or cases where the person is suspected of having one the infectious diseases defined in the laws and enforcement regulations related to medical care.

Guest Rooms

  • During your stay, please check that the door is locked. The guestrooms have auto-locks, so before going out please ensure that you have your card key, and check that the door closes before leaving your room.
  • When someone comes to the guest room, conform who the person is with the door still locked. Do not carelessly open the lock to someone suspicious.
  • Please refrain from talking with visitors in the guest rooms.
  • Please refrain from inviting into your room, or allowing to stay overnight anyone other than resident guests and their companions.
  • Hotel staff may enter guest rooms, they move things around in the room. Please take care of your own money and valuables. Also, if there is anything that you wished to be not moved, please inform the hotel of this in advance.

Shared Spaces, etc.

  • Please check escape route maps and the emergency exits on each floor.
  • Other than during emergencies and when some other unavoidable incident occurs, please refrain from entering or using emergency facilities or accessing the roof. Also, do not enter the areas for the use of staff.
  • Please refrain from leaving belongings in the corridors or lobby.

Photography

  • Without the permission of the hotel it forbidden is forbidden to take photographs or audio recordings for commercial reasons within the hotel grounds. If the photos or audio recordings are taken for personal use, you may not use them for commercial reasons without the permission of the hotel.
  • Please do not take photographs in such a way as to cause inconvenience to other guests or make them feel uncomfortable. Even if it for personal use, there may be cases where we ask you to refrain from taking photographs without the permission of the hotel.

Consideration Toward Other Guests

  • It is forbidden to bring animals, such as pets, into the hotel. However, if there are different regulations, such regulations will be followed. Furthermore, regarding assistance dogs for physically disabled persons as set down in the Act on Assistance Dogs for Physically Disabled Persons, we will accommodate such dogs in accordance with the said law.
  • It is forbidden bring into the hotel anything that gives off a foul odor.
  • Please refrain from behavior such as talking in loud voices, loud singing, having the volume of the television or other audio equipment turned up high, or having arguments or other actions that will cause large noises.
  • Outside of guest rooms, the hotel will ask for use of the hotel in a way that the hotel judges to be desirable.
  • Please refrain from any speech or action that make other guests uncomfortable or any appearance that will make them feel anxious.

Public Order and Standards of Decency

  • Please do not take any actions like gambling or corrupting public morals, which are against public order and standards of decency.
  • It is forbidden to bring guns, swords, and narcotic drugs and other items the possession of which is not permitted by law into the grounds of the hotel.
  • Do not bring into the grounds of the hotel any item that is recognizable as something that would cause other guests or staff to feel anxious, or which threatens their safety.
  • If it is discovered that a staying guest or companion is an organized crime group, or a member thereof as specified in the laws related to the prevention, etc. of unjust actions of organized crime group gangs, or is an anti-social group or a member thereof, all further use of the hotel will be refused.
  • If it is recognized that a staying guest or a person with some relation to such guest has engaged in violence, intimidation, threats, demands, forcible obstruction of business, etc., all further use of the hotel will be refused.
  • If it is recognized that a staying guest or companion a person with some relation to such guest has carried out acts that break laws and ordinances, or that there is a sufficiently strong likelihood of this, all further use of the hotel will be refused.

Maintenance of the Building and Equipment

  • With respect to the equipment and furnishing within the hotel grounds, please refrain from moving them to different locations, altering them, or using them in a way other than their original purpose.
  • Please do not bring into the hotel any gunpowder, volatile oil, items of an ignitable nature, or items that are flammable.
  • Please refrain from using any heating device, whether for warming the room or cooking, in the guest room.
  • Please avoid any action within the hotel grounds that may possibly lead to a fire.
  • In the case where there is any loss, damage, staining, odorization or similar to the building, equipment, fittings or the trees and plants, the hotel may ask the guest to compensate for damages.

Baggage and Lost Articles

  • Please look after your baggage including cash and valuables, There are cases where this hotel may not take responsibility for loss or damage
  • Lost articles found in the common areas within the hotel grounds will be kept for a certain length of time, after which they will be disposed of based on laws and ordinances.
  • If expenses occur in returning lost articles found in the hotel to their owner, such expenses shall be borne by the owner.
  • In cases where a guest has either deliberately or through negligence left an item of baggage in the guest rooms or within the hotel grounds that require a payment to dispose of, such as large refuse, as well as the costs for disposing of the item according to specified in laws and ordinances, an amount appropriate for our expenses in disposing of the item will be demanded of the guest. If no contact regarding the baggage is received within one week after the check-out date, the baggage will be regarded as having been left deliberately and treated as such.

Payment

  • There may be cases where we ask for a deposit, or check your credit card ahead of your use of the hotel.
  • We will not pay on behalf of the guest taxi expenses, expenses for shopping outside the hotel and the costs of other facilities outside the hotel and then allow payment for the total of all these at checkout.
  • If during the stay the hotel makes a request for payment, please make such payment at that time.
  • For the payment of fees, only Japanese yen in cash, accepted credit cards, and other methods accepted by the hotel will be accepted.
  • If you change the accommodation plan from that which you made a reservation, please inform the reception desk. Also if the number of days you stay increases, at same time as the start of the new accommodation contract, we will ask for the bill to be settled at that point.

Accommodation Agreement

(Range of this Agreement)

  • Article 1
    The accommodation contract between the hotel and staying guests and all contracts related to this shall be laid down in this agreement. Any items not laid out in this agreement shall be decided based on laws and ordinances or normally established practices.
  • 2.When the hotels agrees to a special contract that does not violate laws and regulations or practices, regardless of the provisions of the preceding item, the special contract shall prevail.

(Application for Accommodation Contract)

  • Article 2
    People who wish to apply for an accommodation contract with the hotel, are asked to provide the items detailed in the following items
    • Name of the staying guest(s)
    • Length of stay and scheduled time of arrival
    • Accommodation fee (in practice, these are based on the accommodation fees in the attached table 1)
    • Any other items that the hotel deems necessary
  • 2.If staying guests request during there stay to continue their stay beyond the length of stay in Paragraph 2 or the previous item, the hotel will treat this as an application for a new accommodation at the moment the requests was made.

(Formation of accommodation contracts, etc.)

  • Article 3
    An accommodation contract shall be deemed to have been formed when the hotel accepts the application detailed in the previous article. However this may not apply when the hotel demonstrates it has not accepted the application.
  • 2.When an accommodation contract is formed based on the provisions of the previous item, the guests shall make a payment of an amount set by the hotel up to the amount of basic accommodation fees for the length of stay (for stays over 3 days, the payment will be for 3 days).
  • 3.The money paid on application will firstly be put towards the final accommodation fees that guests have to pay. Then, if circumstances occur that lead to application of the provisions of Articles 6 or Article 8, the money will be put towards damages for breach of contract and compensation, in that order. If there is money left over, we will return the money when the customer makes payment in line with the provisions of Article 12.
  • 4. In a case where the hotel has not received payment by the payment date established in Item 2 above, the hotel will regard this as the contract ceasing to be effective. However, this will only apply in cases where the hotel has notified the customer to this effect.

(When payment of money paid on application is not necessary and special contracts)

  • Article 4
    Regardless of the terms in Paragraph 2 of the preceding Article there are cases where the hotel will not require the payment of the money paid after the contract is finalized and will instead agree to a special contract.
  • 2.Once an application for an accommodation contract has been agreed as set out in Paragraph 2 of the previous article, in the cases where the hotel did not request payment of money paid on application or where a deadline for payment of such money was not set, the cases will be dealt with as special contracts as in the previous paragraph.

(Refusal to enter into an accommodation agreement)

  • Article 5.
    This hotel may not enter and agreement in the following cases.
    • The application for accommodation does not comply with this Agreement
    • The hotel is full, so there are no spare rooms
    • When it is recognized that the person intending to stay could possibly in connection with his/her stay take actions that are contrary to provisions of laws and ordinances, public order, or good morals.
    • When it is recognized that the person intending to stay falls into any of the following 3 cases.
      • a) An organized crime group as laid out in the regulations of Article 2 Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter known as organized crime group), an organized crime group member as laid out in the regulations of Item 6 of the same article (hereinafter known as organized crime group member) an associate gang member, someone having connections with organized crime members, and any other antisocial forces
      • b) A juridical person or other group is controlled by an organized crime group or organized crime group
      • c) A juridical person where some of the officers are equivalent to an organized crime group member
    • When the person intending to stay has clearly caused troubles to other guests due to works or actions
    • When it is clearly recognized that the person intending to stay is carrying an infectious disease
    • When violent demands are made regarding the stay, or demands that would require a burden that goes beyond a reasonable scope.
    • When it is not possible to provide accommodation due to natural disasters, damage to facilities and other unavoidable circumstances.

(Guests’ right to cancel the contract)

  • Article 6.
    Staying guests may cancel their accommodation contract by informing the hotel.
  • 2.When the guest cancels or part of their reservation for a reasons attributable to the guest, then the hotel will receive a cancellation fee as set out in Appended Table 2 (this shall not apply to cases where the hotel set a payment date according to Article 3 Paragraph 2 and has requested payment, but before the guest pays the money paid at application the guest cancels the reservation). However when the hotel has agreed to a special contract as in Article 4 Paragraph 1, guests shall pay a cancellation fee only if the hotel explained to the guest at the time of agreeing to the special contract that there is a requirement to pay a cancellation fee.

(The hotel’s right to cancel contracts)

  • Article 7
    In any of the following cases, the hotel may cancel accommodation contracts.
    • When it is recognized that the person intending to stay could possibly in connection with his/her stay take actions that are contrary to provisions of laws and ordinances, public order, or good morals, or that the individual has actually taken such actions.
    • When it is recognized that guest falls into any of the following 3 cases.
      • a) The guest is an organized crime group, organized crime group member, an associate gang member someone having connections with organized crime members, and any other antisocial forces.
      • b) A juridical person or other group is controlled by an organized crime group or organized crime group
      • c) A juridical person where some of the officers are equivalent to an organized crime group member
    • When the person intending to stay has clearly caused troubles to other guests due to works or actions
    • When it is clearly recognized that the person intending to stay is carrying an infectious disease
    • When violent demands are made regarding the stay, or demands that would require a burden that goes beyond a reasonably scope.
    • When because of reasons caused by irresistible for such as natural disasters, it is not possible accommodate them
    • When the guest does not follow the restricted matters in the Terms of Use set down by the hotel, such as smoking in the guest rooms, fiddling with fire-fighting equipment (limited to items that are necessary for fire prevention).
  • 2.When this hotel cancels an accommodation contract, charges will not be received for accommodation services and the like that the guest has yet to receive.

(Accommodation Registration)

  • Article 8
    Staying guests shall register the following items at the front desks on their day of arrival
    • The name of staying guests, their age, sex, address, and occupation
    • If the guest is a foreigner, their nationality, passport number, where and on what day did they enter Japan
    • Date and scheduled time of departure
    • Any other items deemed necessary by the hotel
  • 2.Regarding the payment by guests of the fees as laid in Article 12, guests may use traveler’s checks, hotel vouchers, credit cards and other methods instead of cash. If you intend to use any of these methods, please show them to hotel staff and registration detailed the previous Article.

(Time of usage of the guest bedrooms)

  • The guests are entitled to use the guest rooms of the Shiroiya Hotel from 3:00 pm to 11:00 am the following morning.

(Observance of the Terms of Use)

  • Article 10
    In the hotel staying guest shall observe the Terms of Use set down by the hotel and displayed in the hotel.

(Opening times)

  • Article 11
    The opening times of the main facilities in the hotel are as follows. For information on other facilities, etc., please refer to the pamphlets provided, the various notices, the business directory in the guest rooms, etc.
    • Opening times of the front desk, cashier, and some other services:
      • a. Opening times of the front desk: 24 hours
      • b. The hotel telephone operator is available from 7:00 am to 11:00 pm.
    • Opening times of food and drink services:
      • a. Lounge 7:00-10:30, 11:30-17:00, 18:00-22:00
      • b. Restaurant 18:00-22:00
    • Opening times of ancillary service facilities:
  • 2.The opening times in the preceding items may have to be changed temporarily for unavoidable reasons. In such cases, we will inform guests through appropriate means.

(Payment of Fees)

  • Article 12
    The breakdown of accommodation and other fees is as in Appended Table 1.
  • 2.The payment of accommodation fees can be made in cash, or instead, traveler’s checks, hotel vouchers, credit card as accepted by the hotel. Payment of the fees can be made at the front desk upon guests’ departure or when requested to pay be staff.
  • 3.When the hotel has provided a room for guests and prepared the room for use, it the guests then decide at their own discretion not to use the room, the hotel shall still receive the accommodation fee

(Hotel’s responsibilities)

  • Article 13
    If the hotel through its fulfillment of the accommodation contract and related contracts, or through its non fulfilment of these, causes damages to a guest, the hotel will compensate for such damages, However this shall not apply if the cause is not to the hotel.
  • 2.To enable the hotel to respond in unlikely event of fire etc. it has taken out innkeeper's liability insurance

(Handling of the situation when we are unable to provide a room to a customer with a contract)

  • Article 14
    When the hotel is unable to provide a guest room to a guest who has a contract, with the understanding of the guest, we will contact other lodging facilities to try and secure a room with as similar conditions as possible.
  • 2.If, despite the provisions of the previous items, the hotel is unable to secure a room, we will pay compensation equivalent to the cancellation fee, and this compensation be added to the damages. However in the case where the inability to provide a room is not attributable to the hotel, the compensation will not be provided.

(Treatment of goods deposited)

  • Article 15
    When guests have deposit items or cash and valuables, in the case of loss of, damage to or any other damages, except where this is attributable to a force majeure, the hotel will pay compensation for such damage. However, regarding money and valuables, in the case that the hotel asks for clarification of the type and value , if the guests do not provide this, the hotel only will pay compensation up to limit of 100,000yen
  • 2.If guests bring into the hotel any cash or valuables and they do not deposit these at the front desk, if there are any losses, damage or other damages caused by the hotel’s deliberate or negligent action, the hotel will pay compensation for such damages. However where the customer did not clarify ahead of time the type and value of the item(s), except for cases of where the actions of the hotel were deliberate or a result of gross negligence, the hotel will pay compensation up to a limit of 100,000yen

(Storage of guests’ luggage and belongings)

  • Article 16
    When guests’ luggage arrives ahead of the guests’ date of arrival, only if the hotel has agreed to this ahead of time will the hotel take responsibility and store the luggage, and will hand it over to the guests when they check in.
  • 2.If after guests have checked out luggage or belongings are found to have been forgotten in the hotel, when the owner can be identified, the hotel will contact the owner and ask for instructions. However where the owner does not give any instructions or the owner cannot be identified, we will store it for 7 days including the day on which it was found after which we will send it to the nearest police station.
  • 3.Regarding the responsibility of the hotel regarding the storage of luggage and belongings in the two previous items, in the case of Paragraph 1 responsibility will be based on Paragraph 1 of the previous article , and in the case of the previous article, responsibility will be based on Paragraph 2 of the previous article.

(Responsibility of guests)

  • Article 18
    When damage is cause to the hotel by deliberate or negligent acts of guests, the said guests shall pay compensation for the damage

Notes:
1) The percentages are the proportions calculated from the Basic Accommodation
2) Where the original contract number of days is shortened, regardless of the number of days cancelled, a cancellation fee for 1 day (the first day) is charged
3) When there are partial cancellations from groups (of 15 or more), if the number of people staying as of 10 days before the start of the stay (from this day on if we accept further applications the day when these are accepted) if the number of people staying is 10 percent (the number to be rounded up where this a fraction) then we will not charge a cancellation fee.
